International Trade Law

Attorneys in the international trade group provide a wide variety of U.S. and foreign clients with counsel related to import and export trade, including export licensing, anti-boycott enforcement, customs-related advice, the negotiation of complex international financing instruments and the transfer of proprietary technical information.

We represent U.S. and foreign clients in the negotiation of joint venture, agency, licensing and distributorship agreements around the world, particularly in Europe, the Middle East, the Pacific Rim and Latin America. Our client representation extends into broad areas of local foreign tax, financing, regulatory and corporate law. We maintain the most up-to-date and technologically advanced access to the latest developments in foreign commercial laws, particularly those laws and regulations being promulgated by the European Economic Community. Our ready access to foreign commercial regulations is supported by an international network of correspondent counsels, who offer legal assistance in meeting the needs of our clients engaged in international commercial transactions.

Galland Kharasch also represents multinational corporations investing in the United States. Among these are companies undertaking real estate acquisitions and making stock investments in publicly-held U.S. firms -- activities that require complex international tax and securities advice. For example, we represent major foreign air carriers in negotiating equity investments in large domestic airlines -- engagements that involve both foreign and U.S. securities laws. Also, we have assisted European clients in undertaking both friendly and hostile takeovers of domestic companies, where such assistance requires sophisticated tax and securities capabilities.

Our international commercial services also entail assisting companies -- particularly those engaged in international transportation-related industries -- in ways to solve U.S. and foreign regulatory problems. These include matters related to U.S. Customs service activities, such as classification, valuation, foreign trade zones and foreign asset control, which involves experience with sanctions imposed by U.S. laws. Attorneys in this area also are knowledgeable about export licensing and government procurement regulations unique to international trade, including procurements solicited by the U.S. Department of Defense and the Agency for International Development.

In addition, we represent clients before the U.S. International Trade Administration, the U.S. Court of International Trade, and the U.S. Trade Representatives' Office. These cases are related to special investigations of anti-dumping and countervailing duty complaints as well as commodity trade and customs issues.

The licensing of technical information and the protection of trademarks and industrial know-how are of increasing concern to businesses doing business abroad. We have extensive experience in the enforcement of trademark, patent and unfair competition laws.

Galland Kharasch attorneys have extensive experience representing clients in the purchase and sale of aircraft, general aviation components, vessels, and other goods and commodities. In connection with such acquisitions and sales, we have helped our clients obtain financing and guaranties through private and public lending institutions, including the World Bank, the Export-Import Bank, OPIC and the Agency for International Development.
