Intellectual Property Disputes

We realize that infringement actions are time-consuming and expensive, therefore, we approach all intellectual property disputes in a common sense, cost-conscious manner. Many associations have unique intellectual property infringement issues. Frequently, a former member will continue to use the association’s membership trademark in commerce. Similarly, a person who is no longer certified by a credentialing organization will continue to use the certification mark to promote his services. GKG Law's Association Practice Group monitors associations' trademarks and we make determinations as to whether a third party is infringing on an association’s ownership rights. We draft cease and desist letters for clients and institute and defend trademark enforcement actions before the Trademark Trial and Appeal Board and in Federal court.  

GKG Law's Association Practice Group also works with clients to protect their copyright portfolios. Along with drafting cease and desist letters and negotiating license agreements, we litigate and settle copyright infringement matters on behalf of plaintiffs and defendants. Additionally, we work with associations to limit the online dissemination of copyrighted works and, when necessary, issue take down notices. We assist numerous certification organizations in protecting their secure examinations and related test questions in exam misconduct cases.
